En qualifiant l’ex-président Boni Yayi et des anciens ministres de « complices » dans « l’affaire Madoff béninoise », dont le jugement est attendu jeudi, et requérant des peines allant jusqu’à 12 ans de prison contre des principaux dirigeants d’ICC, le procureur spécial de la CRIET a suscité une vague de soupçons d’une instrumentalisation politique du procès.
Les deux phrases sont massivement commentées à Cotonou depuis près de 48 heures. « Le gouvernement béninois au regard des faits a failli. Thomas Boni Yayi, Grégoire Akofodji et Armand Zinzindohoué sont complices et le ministère public prendra les dispositions aux fins de saisir les juridictions compétentes », a ainsi déclaré le 4 février le procureur Gilbert Togbonon lors de son réquisitoire sévère dans le procès de « l’affaire Madoff béninoise », qui s’intéresse dans un premier temps aux principaux dirigeants de ICC-Services.

Le procureur spécial près la Cour de répression des infractions économiques (CRIET) a requis des peines allant de 5 à 12 ans de prison contre les dirigeants de ICC-Services (Investment Consultancy and Computering Services), une structure de placement illégal de capitaux opérant à la manière des systèmes Ponzi qui a réussi à appâter et ruiner des milliers de Béninois. Au centre du dossier, près de 150 000 victimes et plus de 150 milliards de francs CFA spoliés (près de 230 millions d’euros). L’ex-président de la République, Thomas Boni Yayi, et d’anciens ministres, dont les noms ont été abondamment cités au cours de ce procès fleuve pour une collusion supposée entre son régime et les responsables de ICC-Services, seront appelés à la barre plus tard et devant une haute juridiction, la Haute Cour de justice.
En attendant le jugement du procès, qui interviendra le 7 février, certains justifient la démarche du procureur comme étant destinée à « faire toute la lumière sur cette arnaque du siècle », alors que d’autres trouvent qu’« il outrepasse ses droits » et « montre que le procès est bel et bien politique ».
Un acte manqué du procureur ?
« En déclarant certaines personnes « complices » alors qu’il n’a même pas pris la peine de les écouter en amont, [le procureur spécial] a violé non seulement le principe de la présomption d’innocence mais aussi celui du contradictoire, principe cardinal du procès pénal », précise à Jeune Afrique un magistrat à la retraite sous couvert d’anonymat. Et d’ajouter : « Il n’a même pas la compétence de déclencher la poursuite contre ces personnes devant la Haute Cour de justice. Seul le procureur général de la cour d’appel de Cotonou a ce pouvoir ».
La plupart des anciens ministres cités dans cette affaire nient les faits qui leur sont reprochés. Armand Zinzindohoué, alors ministre de l’Intérieur, qui aurait délivré des permis de port d’arme aux dirigeants de ICC et offert des gardes du corps, a fortement contesté les liens entre les documents officiels qu’il a signés « conformément à la procédure » et la spoliation des déposants.
Dans l’entourage d’Issifou Kogui N’Douro, ancien ministre de la Défense cité au cours des auditions pour avoir réceptionné officiellement un véhicule de patrouille offert par les dirigeants de ICC à la gendarmerie, on dément « tout lien personnel avec les responsables de ICC-Services ». « Il a agi dans le cadre très strict de ses fonctions et sur instruction de sa hiérarchie », souligne l’un de ses proches collaborateurs.
Une tentative pour nuire à Boni Yayi ?
Pour les partisans de l’ancien président Thomas Boni Yayi et de ses ex-ministres, le qualificatif « complices » utilisé par le procureur est un « acte manqué », selon eux, qui révèle l’objectif originel de nuire aux ex-dirigeants du pays.

Selon un communiqué publié le 6 février par la coordination de la 5e circonscription électorale des Forces cauris pour un Bénin émergent (FCBE), le réquisitoire du parquet spécial vise à « traîner le président Boni Yayi et ses partisans les plus fidèles dans la boue pour empêcher leur participation aux prochaines élections législatives du 28 avril 2019 ».
Pendant le procès, d’importantes personnalités ont témoigné sur la complicité de Boni Yayi, président de la République au moment des faits. L’ancien procureur général Georges Constant Amoussou, lors de sa déposition devant la Cour, a affirmé que « le promoteur de ICC-Services est bel et bien Monsieur Thomas Boni Yayi avec la complicité de ses collaborateurs ». Pour Guy Akplogan, directeur général de ICC-Services, Yayi serait à l’origine de la cessation des paiements subie par sa structure : « Nous n’avons jamais eu de problème pour payer nos clients avant la crise », a-t-il soutenu.
Face aux premières accusations, l’ancien président a annoncé avoir mis en place une équipe pour « relever et poursuivre tout acte ou propos qui serait constitutif d’atteinte à son honneur et sa réputation, en cas d’abstention de la CRIET à se saisir d’office de telles infractions ». Le 24 décembre 2018, ses avocats s’étaient insurgés contre « ces affirmations [qui] s’écartent à tout point de vue de la vérité, mais plus gravement, tendent à présenter et installer M. Thomas Boni Yayi dans l’inconscient collectif, comme la source de cette escroquerie à grande échelle ». Ils avaient également annoncé qu’une plainte avec constitution de partie civile pour faux témoignage avait été déposée à l’encontre de l’ancien procureur général.
Des peines qui laissent perplexe
Les Béninois supputent également sur les peines requises. De 5 à 12 ans de prison contre les dirigeants d’ICC-Services, alors que la loi anticorruption qui punit, par exemple, l’escroquerie avec appel public, prévoit une peine maximale de 20 ans. « Vous imaginez, un certain Michel Agbonnon déclare lui-même à la Cour avoir collecté 165 millions de francs CFA mais on requiert contre lui une amende de 75 millions ! », constate le magistrat à la retraite. « Ces gens devraient prendre la peine maximale. Avec ces peines, certains dirigeants de ICC qui ont déjà fait environ 9 ans de prison sortiront très bientôt », s’indigne un déposant très préoccupé par la procédure de remboursement.
Le silence du procureur Gilbert Togbonon sur la responsabilité des personnalités comme Pascal Irénée Koupaki, numéro 2 du gouvernement à l’époque des faits et actuel secrétaire général de la présidence, défraie aussi la chronique. Alors que ce dernier, lors de son audition par la Cour en tant que « sachant », avait déclaré n’avoir été au courant de l’affaire qu’après son éclatement, il a été mis en cause – au même titre que Boni Yayi – par l’ancien procureur général qui avait dit devant la Cour que « l’affaire ICC est un pacte entre Boni Yayi et Pascal Irénée Koupaki pour se relayer au pouvoir ».
« Le procureur ne retient que le nom de Yayi dans ses réquisitions et pas celui de Koupaki. C’est du deux poids deux mesures », souligne un cadre des FCBE.

When she hit the ground she slid downhill face first, using her hands to keep her head from hitting the snow, then came to a stop when she hit the safety netting.

Face à une conjoncture mondiale défavorable, et alors que le secteur n’a pas su développer les capacités de transformation locales lui permettant de maintenir ses revenus, le secteur ivoirien de l’anacarde est confronté à une crise sans précédent. Pour tenter de la juguler, le gouvernement a décidé d’une baisse d’un quart du prix au producteur.
La campagne de commercialisation 2019 de la noix de cajou, qui démarre le 15 février prochain, enregistre une baisse du prix au producteur qui passe de 500 F CFA/kg en 2018 à 375 F CFA/kg, soit une baisse de 25 %. Le recul du prix au planteur ivoirien tient compte de la conjoncture internationale actuelle, dans laquelle les noix se négocient à 1 dollar le kilo.

La campagne écoulée a été émaillée de nombreuses difficultés pour les producteurs, qui n’ont pas pu écouler l’intégralité de la récolte, en raison d’un manque d’acheteurs. En cause, notamment, la fiscalité pesante en Côte d’Ivoire, combinée à la chute brutale des cours mondiaux. Dans le même temps, le niveau de la production en Côte d’Ivoire ne s’est pas adapté à cette conjoncture, atteignant 761 331 tonnes en 2018, contre 711 236 tonnes en 2017. Conséquence immédiate : une baisse des revenus, qui ont atteint 404 milliards F CFA en 2018, contre 509 milliards en 2017.
Dépendance aux exportations de noix brutes
En outre, la Côte d’Ivoire reste toujours dépendante des exportations de noix brutes, avec 642 648 tonnes exportées, malgré l’implantation dans le pays de 24 unités industrielles.
« La transformation locale a augmenté de 50%, avec 66 000 tonnes. Mais elle demeure encore loin des objectifs du gouvernement à parvenir à un taux de transformation d’au moins 50% de la production », a expliqué Sidi Touré, ministre de la Communication et des médias, porte parole du gouvernement, à l’issue du Conseil des ministres de ce mercredi 6 février lors duquel Mamadou Sangafowa Coulibaly, ministre de l’Agriculture et du Développement rural, a annoncé la baisse du prix au producteur.
Depuis plusieurs campagnes, le gouvernement a instauré des mesures incitatives sur la transformation locale, en octroyant notamment une subvention de 400 F CFA/kg aux industriels. Mais ces dispositifs n’empêchent pas les transformateurs de préférer exporter vers l’Inde ou le Vietnam, où les coûts de production sont bas qu’en côte d’Ivoire.

A hero goalkeeper who missed the birth of his twin daughters to play in his side’s FA Cup triumph has spoken of how he feared she would ‘give him some stick’ for not being present at their arrival.
Newport County player Joe Day was seen on live television running off the pitch after his side beat Middlesbrough 2-0, setting up a glamour tie with Manchester City and sending team-mates and fans into a frenzy.
The 28-year-old knew the birth was imminent but had his phone turned off during the win on Tuesday night, meaning he could not be there for the arrival of Sophia and Emelia.

On Wednesday, the exhausted new father said of his wife: ‘I thought I might get some stick but she’s been great. I’m just so proud of her and my two little girls.
‘I knew their birth was on the cards but I just had to shut everything out for the game.’
He added: ‘We always knew there was a chance the birth would fall during the match, but Lizzie backed me and made it an easy decision for me to play the game.

‘Nothing was really happening at midday on Tuesday, but as I was driving to the game Lizzie called me to say that her waters had gone.
‘I got to the ground when she was being taken to the labour ward but she told me to concentrate on the game.
‘I didn’t know the girls had been born when I ran off the pitch at the end. Until I got into my car and called Lizzie I didn’t know what was going on as we’d had no contact since before the game, but Lizzie told me that there was two little girls and they were perfect and waiting for me to arrive at the hospital – and we’ve been here ever since.’
Lizzie, who was kept up to date with news of the football game during labour, said: ‘Joe turned up for the nice bit to have cuddles! We’re absolutely over the moon and the midwives have been so good with me. The care here at the Royal Gwent Hospital has been amazing – with Joe not being here, they couldn’t have looked after me more.’
Day had missed his side’s first FA Cup match against Middlesbrough with the birth of the twins imminent. But after the drawn game he decided to feature in the replay 10 days later, despite his wife being long overdue.
After the game the goalkeeper ran over to manager Flynn, hugged his boss and was then ushered down the tunnel in a bid to make it to the hospital.
Speaking to BT Sport after the win, Flynn, when asked if Day was kept up to date, said: ‘Look, the professional that he is, he turned his phone off.
‘I didn’t hide it believe it or not. I didn’t hide it, he turned his phone off. As soon as the game was over and we won he said “gaffer thank you so much, can I go please?”

Emiliano Sala’s £15m transfer fee withheld by Cardiff City as Nantes demand payment

Cardiff City have been left stunned after Nantes demanded payment for the £15m transfer of Emiliano Sala, who is missing and feared dead, after his flight went off-radar on a journey from France to Cardiff.
The Premier League club were shocked to receive a formal letter from Nantes on Tuesday asking for payment within 10 days.
The two clubs are now embroiled in a legal dispute.

Cardiff’s first payment would ordinarily be due within seven days of the player signing, but the club do not intend to make any payments until the conclusion of official investigations into the causes of his disappearance.
However, Nantes made an email request last Thursday and then followed it up with a formal written request on Tuesday.
Sala’s mother, sister and brother have this week been in the company of the Argentine consular in France as investigations continued after a private plane carrying Sala and pilot David Ibbotson went off-radar on January 21.

The situation has been made more complicated as Sala’s ex-club Bordeaux have sell-on clause
A body has been located in the aircraft but the two families were still to be informed of the identity as of Wednesday.
The Air Accidents Investigation Branch have been searching the English channel for the wreckage.
An official investigation into the crash, including the pilot’s qualifications and the condition of the plane, is likely to follow.

The situation is further complicated as French club Bordeaux are also due 50 per cent of the reported £15m transfer due to a clause inserted when Sala joined Nantes in 2015.
Last week Bordeaux publicly denied that they had invoiced Nantes for their cut of the deal. When contacted by Sportsmail to establish whether they intend to pursue their fee, Bordeaux did not respond.
Cardiff are understood to be insured up to £16m but the club may still incur excess when it comes to covering the salary for the duration of Sala’s three-and-a-half-year contract and the lost revenue that was anticipated for their club record signing. This would take the overall value of the transfer to around £25m.

Nantes are responsible for paying the intermediaries involved. In November, the club enlisted the services of Mercato Ltd, the business run by Mark McKay and his father Willie, who helped organise the doomed flight. Agents Bakari Sanogo and Baba Drame are also due cuts from the Nantes side of the deal.
If the air investigation is followed by involvement from the police, it could therefore be years before the financial and legal disputes are resolved.
In the fortnight following his disappearance, much of the support for the family has come from Sala’s personal agent Meissa N’Diaye, who has worked with the French equivalent of the Professional Footballers’ Association to fundraise for the private search that located part of the aircraft on the seabed.

N’Diaye, who also represents Manchester City’s Benjamin Mendy and Crystal Palace’s Michy Batshuayi, had no involvement with the McKays and has pledged he will provide all the necessary support to the family in the months and years to come.
The Sala family are currently staying in Nantes. When asked to detail what the French club are doing to support the family, the club did not respond.
Sala is understood to have been unhappy at Nantes for much of the past 18 months. His contract was due to expire next year and, despite public suggestions he would be offered a renewal, no offer was forthcoming. Attempts were then made to sell Sala to Italy last summer and, in November, the mandate was granted to British intermediary Mark McKay to secure a transfer by the end of the January transfer window.
Sala had previously turned down a move to China last February and a proposed transfer that would have seen him secure £4.5m per year (net) in salary.

When Sala, a fluent Spanish and French speaker, received an email from Willie McKay touting the Cardiff move in his personal inbox, he was baffled as he did not speak any English.
Indeed, it is believed his initial response to the email was a firm “no”. He was not keen on the transfer to Wales but feeling forced out at Nantes and, aware that Cardiff were the only serious bidders, the striker warmed to the move over the course of January.
Indeed, on his first trip to Wales, he left the premises still undecided as to whether to make the move and insisted he took time to discuss things with friends and family. Ultimately, the transfer went through and the ramifications will endure for years to come.
