Le pilote Patrick Freddy Hofman défraye de nouveau la chronique. Air Mauritius engage une bataille juridique contre lui et lui réclame des dommages de Rs 126 528 025. La compagnie nationale évoque une rupture de son contrat de travail et d’avoir failli à ses obligations envers elle.

Air Mauritius, par le biais de l’avouée Joséphine Robert, a logé une plainte en Cour suprême. Elle réclame des dommages de Rs 126 528 025 à son ancien employé, le pilote belge Patrick Freddy Hofman. L’affaire sera appelée le 28 février 2019.

Dans sa plainte, la compagnie d’aviation nationale indique que les agissements du pilote belge allaient à l’encontre de son contrat de travail et de ses obligations en tant qu’employé. La compagnie soutient qu’il aurait incité d’autres pilotes à organiser un « disguised strike » afin de perturber les opérations aériennes d’Air Mauritius.

La somme de Rs 126 528 025 représente ainsi les dommages et préjudices que la compagnie aérienne dit avoir subis du 5 octobre 2017 au 10 octobre 2017. Ce qui inclut Rs 10 393 800 pour des frais d’hôtel ; Rs 2 038 000 pour le transport ; Rs 12 840 000 comme compensation ; Rs 6 789 000 de frais de « re-routing » ; Rs 260 400 pour des repas ; Rs 1 032 000 pour le coût de l’équipage ; et Rs 10 millions pour « reputational loss ».

Dans sa plainte, Air Mauritius indique que Patrick Freddy Hofman a pris de l’emploi comme ‘Flight Captain’ en 2003, sous un contrat à durée déterminée qui a ensuite été renouvelé. Le dernier renouvèlement du contrat du pilote remonte à 2011, ce pour une période de 10 ans (soit jusqu’en 2021).

Perturbations majeures

Patrick Freddy Hofman a été limogé le 6 octobre 2017, suite à des perturbations majeures dans les opérations aériennes de la compagnie. Selon Air Mauritius, tout cela s’est produit sur l’instigation du pilote à organiser un « disguised strike », ce qui serait illégal.

De juillet 2015 à octobre 2017, Patrick Freddy Hofman a présidé l’Airline Employees Association, syndicat qui regroupe les pilotes étrangers employés par Air Mauritius.

La compagnie compte un autre syndicat, la Mauritius Airline Pilot Association, qui regroupe tous ses pilotes.

La direction de la compagnie dit avoir reçu une correspondance, datée du 5 octobre 2017, des deux syndicats concernant le recrutement de deux jeunes pilotes stagiaires mauriciens sur de nouvelles conditions. Air Mauritius souligne que la lettre termine sur une note menaçante : « if these new recruits are not offered rectified contracts by this afternoon, we will have no option than to advise all members of your bad faith. We believe this will further deteriorate industrial relations past a point of no return and you will then be held entirely responsible for any operation, financial and public image consequences the company will suffer as a result of this ».
Le même jour, pas moins de onze pilotes ont pris un congé de maladie alors qu’un autre a opté pour un congé urgent. La compagnie dit avoir contacté une clinique privée afin de faire examiner les pilotes soi-disant malades. La plupart des examens ont révélé que les symptômes dont se plaignait la majorité des pilotes ne correspondaient pas au traitement qu’ils suivaient. Patrick Freddy Hofman, lui, a refusé de se soumettre à un examen médical.

« Concerted and well-calculated action »

La plainte d’Air Mauritius mentionne l’annulation de plusieurs vols suite à ces perturbations causées par les pilotes. La compagnie a dû replanifier tous ses vols dès qu’une équipe a été disponible. Elle a aussi dirigé des passagers vers d’autres compagnies notamment Emirates, Turkish Airline et Air Austral. La compagnie a également été contrainte d’offrir des facilités d’hébergement aux passagers en attendant leurs vols respectifs.

La compagnie soutient que ces nombreux absentéismes des pilotes ont été une « concerted and well-calculated action », dirigée et manœuvrée par Patrick Freddy Hofman en tant que président d’Airline Employees Association.

Air Mauritius a mis un terme à l’emploi du pilote belge le 6 octobre 2017, considérant les troubles causés dans ses opérations et les inconvénients causés aux passagers. Deux autres pilotes ont aussi été licenciés, avant de réintégrer leurs postes.

La compagnie indique que les 7, 8 et 9 octobre 2017, le nombre de pilotes absents a connu une hausse, jusqu’au 11 octobre 2017 où une réunion a été tenue entre représentants syndicaux et la direction d’Air Mauritius pour trouver un consensus. D’où la bataille juridique qu’Air Mauritius a engagée contre le pilote Patrick Freddy Hofman.

Champion jumps trainer Nicky Henderson described racing as being in ‘serious crisis’ on Thursday night after the BHA decided to halt all action until next Wednesday at the earliest after an outbreak of Equine Influenza at the stable of Donald McCain.

Three unnamed horses trained by McCain have tested positive to EI amid fears that the Cheltenham Festival, which is only 32 days away, could be in danger if the situation gets out of hand.

In all, 21 meetings will be lost if the sport restarts on Wednesday – a six-day shut-down – but the financial damage of the break is chicken feed compared to the potential loss of the Cheltenham Festival if the EI outbreak is not contained.

That would cost the racing, betting and hospitality industries around £200m while a betting industry source said losing this weekend’s meetings would potentially cost the gambling industry £20m.

In attempt to limit the potential spread of the highly contagious disease, the BHA cancelled all four meetings on Thursday before informing all stables which had had runners at Ayr and Ludlow on Wednesday and potentially come into contact with McCain runners that they could not move horses from their stables.

The decision put over 100 stables into lock-down including the top stables of Philip Hobbs, Paul Nicholls, Dan Skelton, Colin Tizzard and Nigel Twiston-Davies.

While the BHA initially hoped it might be able to restart racing if testing the entire McCain stable confirmed that the infection was limited to the three horses that tested positive, the logistic reality of having to test around 1,000 horses spread around the country meant a longer shut-down was needed.

The decision means that Saturday’s prestigious meeting at Newbury, where Cheltenham Gold Cup winner Native River was supposed to clash with King George VI Chase winner Clan Des Obeaux in the Denman Chase, has been called off.

Henderson, who had been due to run Supreme Novices’ Hurdle favourite Angels Breath at Huntingdon on Thursday, said: ‘The news was a bolt from the blue at 6am this morning. I woke up looking forward to running Angels Breath at Huntingdon and within two seconds was hit with the news and all of a sudden we are in a maelstrom.

‘It’s a crisis, a serious crisis. The ramifications are horrendous. We were at Ludlow yesterday and won the last race. I hope it is not the last race for a long time.

‘We cannot have a runner. Tomorrow morning I have six vets in the yard who will start at 6am and have to take nasal swabs from 150 horses.

‘I can live with the build up to Cheltenham (being disrupted) if they say we can’t race. It is not ideal but we are all in the same boat.

THE VIRUS THAT HAS BROUGHT RACING TO A HALT 

WHAT IS EQUINE INFLUENZA?

It is a highly contagious virus which can affect horses, donkeys and mules of any age, sex or breed.

The virus attacks the airways, prevents drainage of fluid from the lungs and can even lead to pneumonia.

Symptoms include a snotty nose, high temperature, muscle soreness and lack of appetite.

HOW SERIOUS IS IT?

The severity of the disease depends on the strain of the virus. It can be dangerous and occasionally fatal to horses that have not been vaccinated, young foals, mares in foal and horses that are already ill with other diseases.

Healthy adult horses are not normally at risk of death. Humans are also not at risk, but can transmit the virus.

HOW DOES IT SPREAD?

The virus is easily transmitted by nose-to-nose contact between horses, indirectly by airborne particles or through contaminated clothing and equipment.

HOW ARE SICK HORSES TREATED?

Infected horses should be isolated. There are no anti-viral drugs but anti-inflammatories can lower temperature and reduce muscle soreness.

In severe cases, intravenous fluids may be necessary and antibiotics can be administered if a secondary infection sets in.

HOW LONG DOES IT TAKE TO RECOVER?

The illness lasts from two to 10 days but it takes up to two months for the respiratory tract to completely repair. Horses should be given a week to recover for every day they were sick.

HOW ARE HORSES PROTECTED?

Thoroughbred racehorses must be vaccinated.

They are given a primary course of three injections followed by an annual booster. Some trainers give boosters more regularly. Vaccinations for a racehorse are recorded in its passport. 

Failure to keep this up-to-date would result in disciplinary action against the trainer from the British Horseracing Authority and a fine.

HAS THERE BEEN AN OUTBREAK BEFORE?

The disease broke out in Australia in 2007 and took six months to be officially eradicated and for horse-related activities to resume.

The BHA confirmed that the situation in the UK is not the same because Australian thoroughbreds, unlike those in Britain, are not vaccinated against flu.

‘The main thing is to knock this on the head as quickly as possible. It might be a sledgehammer to crack a nut but I cannot disagree with what they are doing. I am hopeful everything will be OK.’

The decision to extend the suspension of racing action came after the BHA decided the results of horses tested in the McCain stable would not alone be reassuring enough to resume action.

Even the resumption on Wednesday will not be confirmed until Monday after further discussions with trainers and risk assessments are carried following the results of the EI tests.

On a dramatic day for the sport, questions were raised about the outbreak in the House of Commons and comparisons were drawn with the Foot and Mouth outbreak in 2001 which saw over 60 meetings and the Cheltenham Festival abandoned.

Racing continued in Ireland as five runners at Ayr from the Gordon Elliott stable were halted and placed in an isolation yard before they made it back to his County Meath base.

Seven Flat stables in Newmarket, including that of Godolphin trainer Charlie Appleby, were also included in the shut-down because they had runners at Wolverhampton on Monday when McCain also had a runner.

However, fears stoked by references to the 2007 EI outbreak in Australia which disrupted racing in New South Wales for eight months were played down because at the time Australia did not vaccinate against the disease.

SO, WHO IS TRAINER DONALD McCAIN?  

Donald McCain is one of the top trainers in the country and the leading trainer in the north of England. He is a man also steeped in the folklore of racing.

His late father Ginger was the only man to have trained four winners of the Grand National and guided the career of the legendary Red Rum, the three-time Grand National-winning horse.

Donald took over his father’s stable set in Cheshire during the 2006-07 season and the biggest win of his career so far came in the 2011 Grand National with Ballabriggs.

His best season came in 2011-12 when he trained 153 winners. This season he has had 55 winners.

McCain, who like all trainers in Britain must vaccinate against EI, said in a statement released by the National Trainers Federation: ‘I have been aware of the recent news about Equine Influenza outbreaks in France and Ireland, and over the last couple of days, I have been concerned about the health status of a small number of horses in the yard.

‘Their welfare is at the front of our minds, so at my request, our veterinary surgeon has examined them regularly and we have followed his advice on testing and treatment.

‘It was by following this protocol that the positive results for equine flu came to light yesterday evening. The BHA were contacted immediately and we are liaising closely with them about biosecurity and management of all the horses at Bankhouse.

‘Bankhouse follows all the available advice on disease control and all our horses are fully inoculated. We are scrupulous about observing the health status of horses in our care and taking the necessary steps to treat any condition that may affect them.

‘It follows we would never race any horses that we could have known were infected. When new horses arrive at our yard we, as much as possible, try to keep them separate but at this stage cannot know if the infection came from recent arrivals or from horses returning from racing. 

‘We have three confirmed cases and this morning have taken blood and swabs from all the others for testing.’

Explaining their decision to halt the sport, the BHA praised McCain for acting ‘professionally’.

Racing’s ruling body added: ‘The BHA’s veterinary team has today been in contact with more than 50 trainers and veterinarians to allow it to make an informed assessment of the risk of Equine Influenza spreading.

FEARS GROW IT COULD BE 2001 ALL OVER AGAIN! 

Racing must hope the horse flu outbreak does not cause the same disruption as the 2001 foot-and-mouth crisis. 

Meetings were cancelled across the country, with the sport shut down completely for seven days. In two months of disruptions, more than 60 meetings were cancelled, the most significant being the Cheltenham Festival.

The biggest meeting of the year attracts 200,000 spectators, many of them staying in nearby hotels, and the local economy took a hit estimated at £10million.

‘Whilst no further positive tests have been received, at least three more days are required before it will be possible to make a decision about whether it is safe to resume racing.

‘The disease can take up to three days before symptoms are visible, meaning it will take until Sunday at the earliest before the BHA can gather all the information required.

‘This approach will allow samples to be collected and assessed by the Animal Health Trust in order that a fully informed decision can be made on Monday.

‘This precautionary approach is intended to ensure we put the health of the horse population and control of the virus first, and avoid any unnecessary risk that might come from returning to racing too quickly.

‘We appreciate the impact that this may have on the sport commercially, but disease control in order to mitigate the risk of further disruption to the sport – and safeguard the health and welfare of our horses – must be a priority.

‘A plan will be constructed for the rescheduling of key races – and those which may provide important opportunities for horses to run – which are lost during this period.’

Saturday’s fixture at Newbury would have attracted a crowd of around 7,000 people and the Berkshire course had been buoyed by strong ticket sales.

A spokesperson for Newbury said: ‘We are obviously really disappointed about it but at the same time when it is horse welfare that absolutely comes first and we take absolute guidance from the BHA. 

‘Racing is a sport that is used to abandoning, and we put in place the proper contingencies in terms of insurance.

‘Ticket holders will receive full refunds in the next 14 days. It is such an unusual set of circumstances, but abandoning is something we are used to with adverse weather.’

Propulsé à la tête de l’Assemblée nationale du Venezuela le 5 janvier, Juan Guaido, jeune dirigeant de 35 ans, a multiplié les initiatives pour chasser du pouvoir le président Nicolas Maduro. Alors que l’affrontement entre les deux hommes se poursuit, divisant la communauté internationale et menaçant la stabilité régionale, M. Guaido estime, dans un entretien au Monde, que son rival a désormais perdu le soutien de la population et qu’il est « acculé dans les cordes ».

Beaucoup de choses ont été écrites sur vous ces dernières semaines, vous-même, vous vous exprimez abondamment, mais on a du mal, in fine, à vous situer sur le champ politique. Même le positionnement de votre parti Volonté populaire fait débat. Que dites-vous ?

La question idéologique est, pour moi, un peu anachronique. Ce qui importe aujourd’hui au Venezuela est la mise en place de politiques d’assistance sociales, d’inclusions, d’autonomisations et d’égalité des sexes. C’est essentiel pour les populations les plus vulnérables du pays. L’autre priorité est l’économie. Je soutiens la libre entreprise de marché, l’autonomisation de l’entrepreneuriat et la compétitivité.

Pour le dire simplement, je suis de centre gauche sur les questions sociales. Je partage une grande partie des valeurs de la social-démocratie, en particulier sur les questions liées à la diversité, les avancées en matière des droits. Sur le plan économique, on peut dire que je suis du centre, tendance libéral.

Mais débattre du Venezuela en termes de droite et de gauche est, selon moi, erroné. La triste réalité du pays n’a été que pillage et corruption. Le mot « pueblo », le peuple, a été galvaudé pour voler les ressources de notre territoire. Il n’y a pas d’idéologie là-dedans. La réalité des problèmes du moment touche aux valeurs fondamentales de l’humanité et de la démocratie.

Pour être franc, je pense qu’ils ont été un peu ingrats dans la gestion de la crise vénézuélienne. Ils ont été trop prudents pour dénoncer le régime dictatorial en place parce qu’ils abordaient le problème vénézuélien en termes précisément de droite et de gauche. Peu importe si les dictateurs sont de gauche ou de droite, ils restent des dictateurs opposés à la démocratie.

Blanchiment d’argent lié au trafic de drogue : le clan Neptune tente de vendre des biens

Les enquêteurs de la commission anticorruption disposent des informations selon lesquelles des prête-noms et autres proches du clan d’Hansley Neptune, tenteraient de vendre tous les biens du « JCB Man ». Certaines personnes considérées comme des « proches » du clan sont placées sous surveillance.

Depuis la semaine passée, plusieurs individus de la région de Résidence Kennedy ont été interrogés de manière informelle par l’Intelligence Team de l’Icac. Des véhicules et des motos de grosses cylindrées utilisés par les proches du clan Neptune, intéressent les enquêteurs de l’Icac. Ceux-ci savent que le clan utilise des prête-noms pour acquérir des biens mobiliers, notamment des voitures et des motocyclettes grosses cylindrées.  Hansley Neptune, habitant de Résidence Kennedy, Quatre-Bornes, est recherché depuis novembre 2018, depuis qu’il s’est échappé après une course poursuite.  Il s’agit d’une enquête sur le blanchiment d’argent par les membres du réseau basé à Résidence Kennedy. Hansley Neptune est soupçonné d’être un des pions clés de ce réseau spécialisé dans le trafic d’opiacés. Les enquêteurs de la commission passent également au crible les biens des proches d’Hansley Neptune. La commission n’écarte pas la possibilité que les proches auraient agi comme prête-noms, pour faciliter les achats de véhicules pour le compte de Hansley Neptune.  C’est dans la soirée du 28 janvier,  deux mois après son escapade, que la commission a pu récupérer la tractopelle utilisée par Neptune dans sa fuite. L’engin avait été à abandonné sur un terrain en friche dans la région des Gorges de la Rivière-Noire. Il portait une fausse plaque d’immatriculation, dans le but évident de camoufler l’engin de chantier et empêcher ainsi les autorités de remonter sa piste.

Depuis, le suspect Neptune, alias Coco, recherché depuis plus de deux ans par l’Icac, continue de narguer la police en jouant à l’homme invisible.  Hansley Neptune est soupçonné d’avoir aidé dans l’acquisition de bateaux utilisés pour le transport de cargaisons de drogue, sur l’axe Madagascar-Réunion-Maurice. L’utilisation de bateaux, soupçonnés appartenir au réseau de Résidence Kennedy, était privilégié dans le cadre du trafic de 42,2 kilos d’héroïne et 6,2 kilos de cannabis, pour une valeur estimée à Rs 600 millions.

Le nouveau Haut-Commissaire de l’Inde à Maurice, Shri Tanmaya Lal, qui a pris ses fonctions le mois dernier, a effectué, hier matin, une visite de courtoisie au ministre des Terres et du Logement, Mahen Jhugroo au siège du ministère à Ebène.

Shri Tanmaya Lal était accompagné de son premier secrétaire, Shri Amit A. Shukla. Le Capitaine Peush Pawsey du Indian Naval Survey (INS) Ship le ‘Sarvekshak’ faisait aussi partie de la visite. Etait également présent le responsable du Mauritius Hydrographic Service (MHS), le Commandant Rahul Bhatt.

Les discussions étaient axées sur les liens profonds qui unissent les deux pays et l’étude hydrographique par le MHS du ministère, entre autres…

Le ministre Jhugroo a, par la suite, réitéré ses remerciements envers le gouvernement indien pour l’aide apportée tant dans le domaine du logement que dans celui de l’hydrographie.

Cette fonction s’est achevée par une visite au service hydrographique du ministère où le Commandant Rahul Bhatt a procédé à des explications autour de la science de l’hydrographie.

Fast forward 23 years to this January. Klopp’s Liverpool came into the New Year seven points above Man City.

Going into this weekend’s matches, Pep Guardiola’s defending champions are suddenly top on goal difference.

This midweek’s reversal of fortunes did not bring out the best or most reassuring in Klopp.

Not only did he berate the referee, even though the goal which gifted Liverpool a point against West Ham was allowed despite being palpably offside, he also raged at opposing manager Manuel Pellegrini on the touchline – for what reason, who knows? – and vented his temper at one of his own players in public on the pitch.

Like Keegan, Klopp is an emotional man who wears his heart on his sleeve.

For we onlookers it is all part of the fun and excitement generated by this larger-than-life character, a fundamental element of his charisma. 

He embraces that facet of his fascinating personality by saying: ‘Tactics are important but emotion makes the difference. Football is the only sport where emotion has this big an influence. The best football is always expression of emotion.’ 

But sometimes there is a price to pay. When fortunes turned against him at Borussia Dortmund after he won the Bundesliga and then the German double, he was sent off after a rant similar to the one the other night for which he may face an FA charge.

Then he called time on his reign at Dortmund after the club failed to prevent the sale of his two best players to Bayern Munich.

Even if they regain the upper-hand by beating Bournemouth at home this Saturday, with City facing Chelsea on Sunday, this season’s title race now promises to be a nail-biter to the finish.

Guardiola has turned the screw, more subtly than Fergie, by saying: ‘A few days ago we could have been seven points behind again. Now we are top. The lesson for all is never give up because life can change immediately.’ Got it, Jurgen.

Liverpool do have a game a hand but that will come at Manchester United who, as Sir Alex Ferguson among many will assure us, will be in no mood to help rivals even more arch than the noisy neighbours in their own city.

It is surprising that Liverpool’s bearded saviour has yet to lay hands on any at all during his time in England. But much more astonishing to reflect that it is 29 years since Liverpool won the title.

Many of the Twitter tirades from the Reds faithful suggest that if such a great club fails to end that barely believable famine now, after holding such a commanding lead, then the buck will stop at Klopp.

Keegan never fully recovered from his Newcastle collapse. Four years after that, his sorry spell as England manager ended after World Cup qualifying defeat by Germany with his resignation in the Wembley dressing room toilet.

It would be a ranting shame if Klopp were to be flushed out of our game before his work here is done.

A Londres, le parti travailliste a fait un geste d’ouverture, esquissant un possible compromis avec la première ministre Theresa May.

« Je le dis clairement : je vais faire en sorte que le Brexit ait lieu, qu’il ait lieu dans les temps. (…) Je vais négocier durement pour y parvenir. » Ces quelques mots, Theresa May, présente à Bruxelles, jeudi 7 février, pour tenter de sortir de l’impasse le divorce de son pays d’avec l’Union européenne (UE), aurait très bien pu les prononcer il y a quinze jours, trois, six voire vingt-quatre mois…

A cinquante jours du Brexit, la première ministre britannique voulait surtout donner le change, alors que les Européens campent pour leur part sur leurs positions et refusent de renégocier un traité de retrait qu’elle avait elle-même endossé fin novembre 2018, mais que les députés, à la Chambre des communes, ont sèchement recalé.

Pas question, lui a répété Jean-Claude Juncker, le président de la Commission, de détricoter la partie controversée concernant le « backstop » irlandais, destiné à éviter le retour d’une frontière dure, après le Brexit, entre la République d’Irlande et l’Irlande du Nord.

Dans une nouvelle tentative pour faire voter l’accord à Westminster, Theresa May avait accepté, fin janvier, de soutenir un amendement de son camp conservateur, visant à rediscuter les termes de ce filet de sécurité, jugé indispensable par les Vingt-Sept, car destiné à protéger les accords de paix nord-irlandais, et le marché intérieur de l’UE. « La discussion a été musclée mais constructive », ont fait savoir M. Juncker et Mme May dans une déclaration commune, jeudi.

Les mêmes arguments répétés en boucle

« Le président Juncker souligne que l’accord de retrait ne sera pas rouvert, il constitue un compromis équilibré entre l’UE et le Royaume-Uni, et les deux parties, pour y parvenir, ont fait des concessions significatives », a cru bon d’ajouter la Commission. Elle a fait certes savoir que des « discussions » entre Londres et Bruxelles allaient reprendre, mais M. Juncker ne s’est dit « ouvert » qu’à une renégociation de la déclaration politique, le document accompagnant l’accord de retrait et esquissant la « relation future » entre le Royaume-Uni et l’UE, afin qu’elle soit sur le fonds plus « ambitieuse ». Lui aussi répète les mêmes arguments en boucle.

La vraie nouveauté des derniers jours, c’est le geste que Jeremy Corbyn a effectué en direction de Theresa May. Le leader des travaillistes lui a envoyé une lettre, mercredi 6 février, esquissant un compromis à la Chambre des communes. Il propose que le Royaume-Uni reste dans l’union douanière européenne et soit « étroitement aligné » au marché unique. Il s’agirait d’un Brexit très « doux ».
